We collect Personal Data from a variety of sources, including directly from individuals, through transactions and interactions with our products and services, through our websites and online technologies, from related entities and affiliates, from service providers and contractors, from business partners, from social media platforms, from publicly available sources, from recruiting and employment processes, and from automated technologies such as cookies, tracking pixels, web beacons, analytics tools, server logs, and similar technologies.
We may also use visitor identification, business intelligence, analytics, and similar technologies to better understand which organizations and business customers visit our Site, evaluate engagement with our content, support lead generation, sales outreach, business development activities, and qualify or prioritize prospective business opportunities.

"Do Not Track" Signals.
You should be aware that some websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. Your browser may allow you to transmit a Do Not Track (“DNT”) signal to websites and online services you visit. Like many other websites and online services, our Site does not currently process or respond to DNT signals from your browser or other mechanisms that enable choice. Embedded Content.
The Site contains embedded third-party content from other sources (e.g., videos, images, articles). Embedded content may place third party cookies on your device that monitor your interaction with the embedded content, for marketing purposes or to enhance your user experience. We have no direct control over the information these cookies collect. You should visit the website privacy policy for the third parties that provide this content.
Social Media Widgets.
Our Site includes social media functions, such as the Facebook, Twitter, YouTube, LinkedIn, and Instagram widgets. These widgets may collect information about which pages visitors visit on our Site and the IP address of the device visitors use to connect to the Internet. The widgets may also set a cookie to ensure the features are functioning properly. Social media functions and widgets are hosted by either a third party or directly on the Site. Your interactions with the social media functions and widgets located on the Site are governed by the privacy policies of the companies that provide them. If you use any of the social media functions or widgets on our Site, we strongly suggest you review the privacy policies of the companies that provide those functions and features.
LinkedIn Members.
For our Site visitors who are LinkedIn members and who visit our Site from LinkedIn, our Site may use tracking pixels―transparent graphic images placed on webpages. These tracking pixels, in combination with cookies, collect information contained within your LinkedIn profile as well as your access of and interaction with the web pages that contain the pixels. We may work with LinkedIn to provide Sponsored Updates and advertisements about our Services on your LinkedIn News feed. Disclosures of Personal Information.
We may disclose your Personal Information to:
- Service providers, contractors and third parties who help us provide the products and services such as shipping, payment processing, marketing and advertising, email, text and other communications, applications, sales, lead management, workflow automation, business and inventory support, photography, and website, software, platform, cloud, data storage and other technical services. How Long We Keep Information.
The length of time we keep the Personal Information we collect depends on the purpose for which we collected it. In all cases, we keep this information for as long as is necessary to fulfil the purpose for which we collected it. We may retain your Personal Information for longer if it is necessary to comply with our legal obligations or reporting obligations, (e.g., resolve disputes, collect fees, etc.) or as permitted or required by applicable law. We may also retain your Personal Information in a deidentified or aggregated form so that it can no longer be associated with you.

We may transfer the Personal Information we collect about you to recipients in countries other than the country in which the Personal Information was collected. Those countries may not have the same data protection laws as the country in which you initially provided the information.
Our Site and the servers that make this Site available worldwide are generally located in the United States. The Internet laws in the United States govern all matters relating to this Site. Any information you provide in subscribing to our Site or registering or ordering at our Site will be transferred to the United States. How We Protect Personal Information.
We incorporate reasonable and appropriate administrative, physical and technical measures designed to protect the security of Personal Information we collect from you including limiting access to Personal Information to those DIRECT REFRIGERATION employees or agents with a specific need to access or retrieve this information. We store data on multiple service systems in controlled environments. To maintain security, we conduct internal reviews of our security measures on a regular basis. However, no system for safeguarding personal or other information is 100% secure and we cannot fully eliminate security risks associated with Personal Information.
In addition, while we use reasonable measures to protect our Site and your information, the Internet is not 100% secure and we encourage you to use caution when using the Internet.

The Site may provide link to other websites that are neither under our control nor maintained by us. Such links do not constitute endorsement by us of those other websites, the content displayed therein, or the persons or entities associated therewith. Children’s Privacy.
None of the information on the Site is intended for the use of children under thirteen (13) years of age, and DIRECT REFRIGERATION does not knowingly register any person or accept information from any person under sixteen (16) years of age.
Updates to Our Privacy Policy.
We will occasionally update this Policy as necessary to protect our users and to comply with a changing environment. We recommend that you check the Policy when you visit our Site to be sure that you are aware of and understand our current privacy policy. If we make material changes to this Policy, or in how we use or collect your Personal Information, we will prominently post such changes prior to implementing the change. Applicable Law.
This Policy is governed by the laws of the State of Texas, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Policy shall lie exclusively with the state and federal courts within Texas. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.

This section supplements and amends the information contained in the Policy with respect to California residents. The other provisions of the Policy continue to apply, except as modified in this California section.
Shine the Light.
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of the Company to third parties for the third parties’ direct marketing purposes. Requests may be made one time per calendar year. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we disclosed customer information for the immediately prior calendar year (e.g., requests made in 2022 will receive information regarding 2021 sharing activities). You may submit your request using the contact information in this Policy.
California Consumer Privacy Act.
The following provisions describe our policies and practices regarding the collection, use, and disclosure of Personal Information including information we obtain when you access or use the Site, or through other channels (e.g., phone and email conversations, when you visit our locations or attend our events, or through our authorized services providers), in accordance with the California Consumer Privacy Act, as amended (“CCPA”).

Security of Personal Information and Security Incident Notification
Direct Refrigeration maintains administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, acquisition, disclosure, alteration, misuse, or destruction. While no method of transmitting or storing information can be guaranteed to be completely secure, we use commercially reasonable measures designed to protect Personal Information consistent with applicable legal requirements.
If Direct Refrigeration becomes aware of a confirmed security incident involving Personal Information, we will investigate the matter, take appropriate steps to contain and remediate the incident, and comply with applicable legal and regulatory obligations. When required by law, Direct Refrigeration will provide notice to affected individuals, customers, regulators, or other parties within the timeframes prescribed by applicable law.
Consumer Rights.
California residents have the following rights with respect to the Personal Information we collect about them subject to certain limitations.
Right to Know About Personal Information Collected or Disclosed. We describe in this Policy our current practices as they relate to how we collect, use and disclose Personal Information. As a California resident, you have the right to request that we disclose additional information as it relates to our data collection activities during the preceding 12 months. To the extent applicable, you have the right to know:

- the categories of sources from which we collected the Personal Information
- the business or commercial purpose for collecting, selling, or sharing Personal Information, if applicable
- the categories of Personal Information we sold or disclosed for a business purpose

Upon receipt of a verifiable consumer request and as required by the CCPA, we will provide a response to your requests. Any disclosures we provide will only cover the 12-month period preceding the receipt of your verifiable consumer request. With respect to Personal Information collected on and after January 1, 2022, and to the extent expressly required by applicable regulation, you may request that such disclosures cover a period beyond the 12 months referenced above, provided doing so would not require a disproportionate effort by us.
Right to Delete. You have the right to request that we delete Personal Information we collected or maintain about you, subject to certain exceptions. Upon receipt of a verifiable request, we will delete and direct any service providers, contractors and third parties to whom we disclosed your personal information, to delete your Personal Information.
We are not required to comply with deletion requests if we, or our service providers, contractors, or third parties need the subject information to:
- Complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably anticipated by you within the context of our ongoing business relationship with you, or otherwise perform a contract between the Company and you.
- To ensure security and integrity to the extent the use of the consumer’s PI is reasonably necessary and proportionate for those purposes.
- Debug to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided by law.
- Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
- Engage in public or peer-reviewed scientific, historical, or statistical research that confirms or adheres to all other applicable ethics and privacy laws, when the Company’s deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if you have provided informed consent.
- Comply with a legal obligation.
- Otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.
Upon receipt of a verifiable consumer request and as required by the CCPA, we will provide a response to your requests. Right to Request Correction. You have the right, subject to certain limitations, to request that we correct any inaccurate Personal Information we maintain about you. Upon receipt of a verifiable consumer request, and as required by the CCPA, we will take appropriate steps to respond to your request.
Right to Non-Discrimination for the Exercise of Privacy Rights. We will not discriminate against you for exercising any of your rights under the CCPA. This includes but is not limited to: (A) denying you goods or services; (B) charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (C) providing you with a different level or quality of goods or services; or (D) suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services. Employees, applicants, and independent contractors have the right not to be retaliated against for exercising any of their rights under the CCPA.
Employee and Applicant Information.
Personal Information collected from California job applicants, employees, contractors, and other workforce members is subject to Direct Refrigeration's separate Employee Privacy Notice, which is provided at the time the information is collected and describes the categories of information collected, purposes of processing, retention practices, and rights available under applicable law.
Submitting Consumer Rights Requests
How to submit. To submit a California consumer rights request, please contact us at or 1-800-000-0000]. Verifiable Requests. We reserve the right to only respond to verifiable consumer requests to Know, Delete, or Correct. A verifiable consumer request is one made by any individual who is:
- the consumer who is the subject of the request,
- a consumer on behalf of the consumer’s minor child, or
- the authorized agent of the consumer.
To verify your identity, we may ask you to verify Personal Information we already have on file for you. If we cannot verify your identity from the information we have on file, we may request additional information which we will only use to verify your identity, and for security or fraud-prevention purposes. Making a verifiable consumer request does not require you to create an account with us. Additionally, you will need to describe your request with sufficient detail to allow us to review, understand, assess, and respond.
Authorized Agents. You may authorize a natural person or a business (the Agent) to submit a Request to Know, Correct, Delete, Opt Out of the Sale/Sharing of Personal Information, or Limit Use of Sensitive Personal Information on your behalf. The Agent must provide signed permission to submit the request, and you must either (i) verify your own identity with the business or (ii) directly confirm with us that you provide permission to the Agent. These steps are not required when you have provided the authorized agent with power of attorney pursuant to Probate Code sections 4000 to 4465. We reserve the right to deny requests from persons or businesses claiming to be authorized agents that do not submit sufficient proof of their authorization.
Our response. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
We reserve the right to charge a fee to process or respond to your request if it is excessive, repetitive, or manifestly unfounded. If we determine that a request warrants a fee, we will attempt to notify you as to why we made that decision and provide a cost estimate before completing your request. We will endeavor to respond to a verifiable consumer request within forty-five (45) calendar days of receipt, but we may require an extension of up to forty-five (45) additional calendar days to respond and we will notify you of the need for the extension.
